VIOLATION FEES FOR YARD MAINTENANCE
At our January 2019 BOD meeting, a motion was made to amend Article XI, section 5 of our CC&R for yard violations. At our APRIL 2019 HOA meeting, violation fees for yard maintenance were voted on, and passed unanimously by all homeowners present.
Effective APRIL 16, 2019: Violations for yard maintenance would also include garbage cans and recycling containers left out for more than 1 day after garbage/recycle removal; also bicycles, lawn mowers, toys, etc. left out in the front of the home for more than 1 day. The daily fine for non-compliance is $10.00 per day.
Grass mowing must be done weekly, or within 2 weeks between cuts. If a homeowner doesn’t comply, the HOA will have the yard mowed and the homeowner will be responsible for the fees incurred by the HOA on their behalf. In addition, an extra $10 fine will be added to the cost for HOA management.
Recycling material, household garbage, and any other form of trash may not be placed on the street curb more than 24 hours prior to the collection of such items. Any of these trash related items not collected by sanitation workers must be removed from the curb within 24 hours of said trash removal day. Any home in violation will be subjected to the same $10.00 per day fine.
VIOLATION LETTERS ARE GOING OUT JULY 2018 AND BEYOND
At our July 2018 HOA meeting, several homeowners in attendance complained about the many violations that are occurring in our subdivision, and what is being done to remedy these situations.
The Board of Directors and homeowners in attendance unanimously voted in favor of stepping up the enforcement of the CC&R rules and regulations for our subdivision.
Violation letters and fines are going out immediately after July 16, 2018. Our HOA is also presently looking into retaining an attorney should we need legal help to enforce our CC&R’s for those who refuse to comply. We currently have (as of the November 12, 2018 meeting) five (5) homes liened for non-payment of dues and violation fines.
HOMEOWNERS NOTE: If you are selling your home, make sure you give your potential buyer a copy of the CC&R to review before purchasing. Once they buy, it is understood they are in compliance with our rules and regulations, no exceptions.
LANDLORDS NOTE: If you own a rental property in our subdivision, you are responsible for your tenants to uphold the CC&R’s on your behalf. No exceptions.
REALTORS: If you are negotiating a purchase in our subdivision, or are a rental agent/property manager, make sure your client gets a copy of our CC&R documents. The download is on our homepage.
HOA DUES INCREASED IN 2020
Earlier this year at our HOA board and budget meeting, it was voted that our HOA dues will be increasing in 2020 to $151.00 per home. Our HOA dues have not been increased for several years, but due to increasing costs of services, we must increase our dues this year and in future years to catch up to the increases and keep our annual budget balanced.
DEED RESTRICTED, NO SOLICITATION SIGN INSTALLED
When entering our subdivision you should now see DEED RESTRICTED COMMUNITY and NO SOLICITATION sign that was installed. If you have anyone soliciting knock on your door, feel free to reference the sign.
PLEASE READ YOUR NEW HOA CC&R DOCUMENTS, THEY COULD EFFECT YOUR PROPERTY, AND YOU COULD BE SUBJECT TO FINES AND LEINS.
At our April 2014 Board of Directors meetings there was a discussion regarding the safety and misuse of our common pond areas. Recently many under-aged youths have been trespassing on homeowners property to gain access to the ponds. They have been littering and throwing items such as used auto tires amongst other items into our ponds. A decision by the board was made to limit the use of these common areas to only the “Owners” of this subdivision, and plans are in place to restrict entry into these areas where applicable. The board also consulted the HOA’s insurance company about our HOA’s liability regarding ALL youths and adults entering common areas. They have strongly suggested we post NO TRESPASSING / NO LOITERING signs within these common areas for an extra layer of protection. If you have children under the age of 18 years old, they must now be accompanied by an adult “Foxchase 4&5 HOA Owner” that currently resides in this subdivision.
Another issue that was discussed at the April 2014 board meeting was the handling of estoppel letters for home closings. Since there are many homes in our subdivision that have outstanding dues owed and consequently have liens placed on them, in the case of a sale in any form (privately or through foreclosure), when we receive an estoppel letter for the purpose of a sale, there will be an estoppel fee included that will range from $250.00 to $400.00 for the estoppel preparation. This fee is based on several different factors in the preparation of the estoppel letter.
NOTE: There WILL NOT be an estoppel fee for any property that is “good standing” at the time of sale. (Good Standing is all dues are paid up to date)
NOVEMBER IS ELECTION TIME!
Nominations are taken at our October meeting each year. Ballots for our annual Board of Directors election will be delivered to the members of our HOA that are in good standing. Ballots have a due date, please make every effort to send yours in so it could be counted. IMPORTANT: Only ballots from members in “good standing” will be counted, so if you want your vote to count, make sure your dues and any outstanding balances are up to date.

Our HOA meetings are held quarterly, look for sign to be posted at the entrance to our subdivision for more details. Meetings are held at St. Giles Church, Blanding Blvd & Foxridge Road and typically last twenty minutes to one hour in length.
IMPORTANT: AS A COURTESY TO ST. GILES CHURCH FOR THE USE OF THEIR FACILITY, PLEASE BRING A DONATION OF NON-PERISHABLE FOOD FOR THEIR FOODBANK.
ST. GILES ALSO COLLECTS CLOTHING AND BLANKETS/SHEETS FOR THE CLOTHS CLOSIT LOCATED OFF DEBARRY IN ORANGE PARK.
